Holiday and final pay · Great Britain
Do I get paid for unused holiday if I get sacked?
Yes. If you have accrued statutory annual leave left when your employment ends, your employer must pay for it, including if you were dismissed for gross misconduct. Use your employment end date and check how much statutory leave you had already taken.
What about extra contractual leave?
Your employer can set separate rules for holiday above the statutory minimum. A contract may restrict payment for those extra days on dismissal for gross misconduct. Ask payroll to show how it separated statutory and extra leave and which term it relied on.
Check your final pay
Ask for a breakdown of the leave accrued, days used and holiday pay included. The holiday entitlement calculator estimates the balance in days for a regular working pattern. If your role was made redundant, the redundancy calculator estimates a separate payment for eligible employees.
